- Orders are accepted on the condition that they shall be executed at prices current at date of delivery.
- The ownership of the goods listed on this invoice will not pass to the buyer until such time as payment has been made in full to Athrodax Healthcare International.
- Satisfactory trade and bank references are required for new accounts.
- Delivery times quoted are estimates only. Whilst every effort is made to dispatch within specified times, the company can accept no responsibility for delays caused by factors outside its control.
- Goods delivered in correct execution of an order may on no account be returned without the company’s previous agreement in writing. Failure to obtain this agreement will result in the company refusing to accept return of goods.
- A handling charge of not less than 15% of the invoice value will be made on goods returned which were supplied in correct execution of an order and which are not defective.
- Cancellations cannot be accepted for goods which have already been dispatched or ordered from suppliers unless the supplier is prepared to accept return of goods from Athrodax at full credit.
- Claims for defective goods will not be entertained unless notification has been made within 14 days of receipt of those goods.
- When goods are specifically made to the customer’s specification and supplied by Athrodax Healthcare International the company shall be indemnified by the customer against all damages and costs in respect of infringement of Letters Patent or Registered Design. In the event of discontinued use of such items the customer cannot return goods to Athrodax Healthcare International, and is bound to purchase remaining items held in stock by Athrodax for that customer.
- Athrodax Healthcare International’s liability on goods found and agreed to be defective is limited to free replacement only if notification has been made within the specified period.
- Prices quoted and accepted for NHS contracts shall be maintained for the period of the contract unless otherwise notified in writing at least one month prior to the proposed change whether it be an increase or decrease.
- Cancellation of items on contract or standing order can only be made if the company has received one month’s prior notification in writing of the proposed cancellation.
- It is an express condition of sale that the sellers have lien on the goods until they are paid for.
- The conditions of sale are subject to English law.
